Roof Certification Leak Warranty
WHAT IS A ROOF CERTIFICATION?
There is no standard definition for a Roof Certification. You could probably talk to ten different Roofing Contractors about the meaning of a Roof Certification and you will get ten different answers. A Roof Certification is, loosely, a written opinion issued by a Licensed Roofing Contractor to certify that a roof is free of defects and should perform as designed for a certain period of time.
The Roof Certification period is usually for 1 or 2 years and can be up to as many as 5 years. But, be very careful, a Roof Certification is not always a Roof Warranty against future roof leaks. Unless you have done business with a certain Roofing Contractor, you will need to know what their Roof Certification is all about, and what is included in, or excluded from, their Roof Certification.
WHEN IS A ROOF CERTIFICATION NEEDED?
In most cases, the requirement for a Roof Certification arises at the time that a Buyer is purchasing a home. A Buyer typically hires licensed professionals to inspect the home that they are looking to purchase. These inspections can alert the Buyer to roof problems that will require roof repairs and the issuance of a Roof Certification prior to closing on their home purchase.
The lender’s appraiser can also find roof problems that will require the issuance of a Roof Certification as a condition prior to: drafting loan documents, funding the loan, or closing the loan. An insurance company underwriter may decline a homeowner insurance policy on a home until they have received a Roof Certification to mitigate their risk on a home with a questionable roof. With many of the homes being bank owned, and being sold as-is, it is wise to obtain a Roof Certification to make sure that the roof will not be a problem in the near future.
MAKE SURE YOUR ROOF CERTIFICATION IS A WARRANTY FROM FUTURE ROOF LEAKS FOR THE ENTIRE ROOF
Because there is no standard definition for a Roof Certification, it is critical to understand what the Roofing Contractor is promising when they issue their Roof Certification. Just because you have been issued a Roof Certification does not mean that this Roof Certification is a Warranty from future roof leaks. A typical Roof Certification will describe what is being certified and will contain a list of exclusions or pre-existing conditions that are specifically not covered by the Roof Certification.
Many Roof Certifications are required as a condition of buying or selling a home, escrow closes, and the roof subsequently leaks, only to find out that the new leak repair is not covered under the Roof Certification because of an exclusion, a pre-existing condition, a dollar limitation, or that the Roof Certification was not a Leak Warranty.
A Roof Certification can also state that it is not a warranty against future leaks, which means that if there is a subsequent leak, the Homeowner is required to fix the leak at their own expense. Some Roof Certifications may only apply to a repair that was recently completed but not cover the rest of the roof. Be absolutely certain that you understand, whether or not, your Roof Certification is a Warranty for repairs from any future roof leaks for the entire roof, otherwise it is worthless to you.
MAKE SURE YOUR ROOF CERTIFICATION HAS A NO-DOLLAR LIMITATION ON A FUTURE ROOF REPAIR
It is quite common that buried somewhere in the middle of a Roof Certification Leak Warranty, or in the fine print, that there is a maximum limit on the dollar amount to be paid on a roof repair for a future roof leak. This limit is usually around $1,000. What a dollar limitation means is that any future roof leak repair that exceeds the amount of the dollar limitation will become the responsibility of the homeowner to pay, regardless of what the future repair bill may be.
Nationwide home warranty companies will offer their home warranty with optional roof coverage for an additional fee. But, these home warranty companies will never inspect the roof before the issuance of their home warranty policy and therefore the condition of the roof is not known. Problems arise after the issuance of their home warranty policy when there is a subsequent roof leak. The homeowner then has to pay up to $100 for a service charge to have the roof inspected by an outside roofing contractor hired by the home warranty company, who may find that substantial roof repairs are needed or that a roof replacement is required. Then the homeowner realizes that they will have to pay for a majority of these roof replacement or roof repair costs because of the dollar limitation described in their home warranty policy.
Those roofing companies who perform a Roof Inspection, then perform the roof repairs described in their Roof Inspection Report, and then issue a Roof Certification and Leak Warranty with a dollar limitation are attempting to transfer the risk of any future roof leak back onto the homeowner for their company’s failure to find present and future roof leak conditions. We do not feel that it is good business practice to issue a roof leak warranty and then apply a dollar limitation to the warranty on any future roof leak. Any Roof Certification or Leak Warranty that contains a dollar limitation is not in your best interest and should be declined. Be absolutely certain that you understand whether or not your Roof Certification has a dollar limitation for any future roof leaks.
